These Terms govern your use of TorchLake.com and its services (the "Site"), operated by TorchLake.com. By using the Site you agree to these Terms. If you do not agree, do not use the Site.

1. The Site

The Site offers a vacation-rental listing directory, @torchlake.com email service, live camera views, local news, local advertising and, in the future, merchandise. Features may change or be discontinued at any time.

2. Vacation rentals

The rental directory is governed by our Vacation Rental Disclaimer, which is incorporated into these Terms. We are not a party to any rental between Guests and Hosts.

3. Host accounts and listing fees

Hosts pay a monthly subscription per active listing at the rate published on the Site. Each new listing is free for the introductory period published on the Site (currently its first month), starting the day it is approved; the introductory period is given once per listing. Fees are billed in advance, are non-refundable except where required by law, and are for advertising only — they do not create any agency or partnership. We may approve, reject, suspend or remove listings at our discretion, including for inaccurate content, complaints, non-payment or violation of these Terms. Hosts must have the legal right to rent each property they list and must keep listings accurate and current.

4. Email service

@torchlake.com email accounts are billed monthly and include the storage and number of addresses stated on the Site. You may not use the service to send spam, unsolicited bulk mail, phishing, malware or unlawful content, or in any way that harms our systems or reputation. We may suspend accounts for abuse or non-payment. Addresses remain our property and may be reassigned after cancellation. You are responsible for backing up your mail; we are not liable for lost messages.

5. Live cameras, news and third-party content

Camera feeds and news are provided for general information only, may be delayed or unavailable, and must not be relied on for safety, weather, water or navigation decisions. News items may be gathered with automated tools and summarize or link to third-party sources; we do not guarantee their accuracy. Advertisements are provided by local businesses, and we do not endorse any advertiser.

6. Acceptable use

You agree not to post false, misleading, infringing, discriminatory or unlawful content; scrape or copy listings; interfere with the Site's operation; or use the Site to harass anyone. You grant us a license to display content you submit (such as listing text and photos) on the Site and in promotion of the Site, and you confirm you have the rights to that content.

7. Disclaimer of warranties

The Site is provided "as is" and "as available." We make no warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, availability or non-infringement.

8. Limitation of liability

To the fullest extent permitted by law, TorchLake.com is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from your use of the Site or dealings with any Host, Guest, advertiser or third party. Our total liability for any claim is limited to the amount you paid us in the three months before the claim arose, or $50 if you paid nothing.

9. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your content, your use of the Site, or your violation of these Terms or the law.

10. Governing law

These Terms are governed by the laws of the State of Michigan. Any dispute will be brought in the state or federal courts serving Kalkaska County, Michigan.

11. Changes and contact
