Vacation rental disclaimer

In short: TorchLake.com is an online advertising directory. We are not a booking agent, real-estate broker, property manager or party to any rental. Every booking, payment and agreement is solely between the guest and the host.

1. Directory service only

The vacation rental section of TorchLake.com (the "Site"), operated by TorchLake.com ("we", "us"), allows independent property owners and managers ("Hosts") to advertise short-term rental properties and allows visitors ("Guests") to contact Hosts. We do not own, operate, manage, lease, inspect, license or control any listed property.

2. No part in bookings or payments

We do not accept reservations, collect or hold payments, deposits or security deposits, issue refunds, or charge guests any fee. Inquiries sent through the Site are forwarded to the Host. Any booking is made directly between Guest and Host on terms the Host sets. We are not a party to, and have no responsibility under, any rental agreement.

3. Hosts are solely responsible

Each Host is solely responsible for their listing and property, including: the accuracy of descriptions, photos, amenities, rates and availability; rental agreements, house rules and cancellation and refund policies; collecting and remitting all applicable taxes (including Michigan sales and use tax and any local lodging or assessment taxes); obtaining any required licenses, permits or registrations and complying with township, county, HOA, deed and zoning rules; insurance; property safety, including smoke and carbon-monoxide detectors, water and dock safety; accessibility; and all applicable fair-housing, consumer-protection and privacy laws.

4. No verification or endorsement

We may review listings before they are published, but approval is not an inspection, verification, endorsement or guarantee of any kind. We do not verify Host identity, ownership, authority to rent, licensing or the condition of any property. Calendars synced from other platforms may be delayed or inaccurate; availability is confirmed only by the Host.

5. Guest responsibilities

Guests should independently verify the Host and property, read the Host's rental agreement before paying, use secure payment methods, and never wire money or pay with gift cards to someone they cannot verify. If something seems wrong, stop and contact us.

6. Limitation of liability

To the fullest extent permitted by law, we are not liable for any loss, damage, injury, illness, death, dispute, cancellation, fraud, misrepresentation, property condition, lost deposit or other claim arising out of or related to any listing, property, stay, communication or transaction between Guests and Hosts, or the use of the Site. The Site is provided "as is" and "as available" without warranties of any kind, express or implied.

7. Indemnity

Hosts agree to defend, indemnify and hold harmless TorchLake.com and its owners, employees and agents from any claims, damages, costs and fees (including reasonable attorney fees) arising from their listing, property, rental activities or violation of law or these terms.

8. Reporting a listing

To report a listing you believe is fraudulent, unsafe or inaccurate, email info@torchlake.com. We may remove any listing at our discretion.
